Actually I think you can get your money back, but they have to bust the seller. It's not your fault because you didn't know what you were buying.

Yes, but the seller probably didn´t know either, who knows how many owners it had between ´99 and now.

I disagree, if Lee doesn't want to reimburse him, he won't get anything back. I know this from personal experience. I was held up at gun point and had $200 taken from me. They caught the guy and I testified against him. He was convicted and sentenced to life (repeat offender). I got nothing. Also, my fiance's engagement ring was recently stolen and the cops told me that if I find it in a pawn shop to call them immediately and not to tell the pawn broker. The police would then come and tell the pawn broker that it belonged to me. I would get the ring back, but the pawn broker wouldn't get shit, because it was not their's to own/sell in the first place. So basically if they buy a stolen item and it's claimed, they are up shit creek... that's why stores that buy used items typically have a 30-day "check" period before they sell it.

This guitar was stolen in the US. Then eventually sold to FenderBob in the US. Then FenderBob sold it to Saurkraut. All the owners from Lee to Sauerkraut had no right to it. Technically, Lee doesn't have to reimburse anyone for what was rightfully his. I'm sure he filed a police report in '99 so there's proof of his possession and the theft.

Although, there's no reason to suggest Lee won't reimburse him, there's none to suggest he will.

DISCLAIMER: I'm not a lawyer, I'm just stating my opinion from past experiences.

Good luck!  :)

Different US States have different laws regarding pawn shops selling stolen items.  In Nebraska, for instance, a pawnbroker may sell stolen goods if he or she turns in to the police the person who pawned the items.  It was felt that by penalizing the pawnbrokers for informing, too many thieves were going free, as there was no incentive to turn them in.

So, this leads to the sad spectacle of  theft victims having to buy their own property back from a pawnbroker.   Yay, Unicameral.  >:(

What about ebay "buyer protection"?

And I think you don't have to buy a stolen item that was yours from a pawnbroker,  you can simply tell the police it is stolen if you had reported it earlier, in Europe you can anyways, but I am not sure if there is a maximum time to do this.

Hmm... it would be crazy awesome if Lee subsequently became a member here...

But it's not that unlikely. Judging from his taste in gear (from the Sonic Youth Gear Guide) I would assume he reads about it on the internet. He's been using some boutique stuff lately, among other things.

I did preface with 'it would be crazy awesome' not 'it is terribly likely'....

Anyway, hope the gear gets into the right hands. Keep us updated.
