I guess all he's really selling is a relicing process on parts he's aquired for you.  Still seems shady and doesn't change the fact that reselling the Fender logo (every "Nash" guitar I've seen has a Fender logo) is infringing on their trademark. He may not say he is selling a real Fender guitar but the fact that it looks like a Fender guitar and sits on a dealers wall with Fender on the headstock could mislead the customer to belive otherwise.  Like I said, I could give two shits wether it has a Fender logo, I'm just suprised he's still in business. And I'm not a lawyer so maybe I'm way off base.

I think that's about all they (Fender) can do... keep him from implying that they are actual Fender products (and therefore forgeries).
As for reasons others might I guess some like the look and don't have or want to invest the time to create their own.

Bill Nash lives and has his shop in my town...Olympia, WA. He almost got sued (cease and desist) by the big "F" in 2005 for his amazingly similar creations. He's not allowed to take custom orders himself any longer, he pretty much exclusively sells through his small network of dealers. And as far as I've heard from people in the know, authorized Fender dealers cannot carry Nash Guitars.

Actually, come to think of it my '72 tele's headstock is pretty bad too, it's nearly brown!

My '73 jazz bass has that as well. The difference in colour between the front of the headstock (in nitro) and the rest of the neck (in poly) is quite extreme. The bass is finished in walnut, and it almost looks like it has a matching headstock.

hee hee that's a very "pre-sunbed" era Dale Winton - he looks far more orange to me!
